{"id":1380,"date":"2019-08-09T10:45:58","date_gmt":"2019-08-09T10:45:58","guid":{"rendered":"http:\/\/insight.thomsonreuters.com.au\/?p=1380"},"modified":"2022-08-03T16:03:57","modified_gmt":"2022-08-03T05:03:57","slug":"has-queenslands-recent-domestic-violence-legislation-been-a-success","status":"publish","type":"post","link":"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/has-queenslands-recent-domestic-violence-legislation-been-a-success","title":{"rendered":"Has Queensland&#8217;s Recent Domestic Violence Legislation Been a Success?"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">Domestic violence has been heavily covered in the media over\nthe last few years, with several governments across Australia launching\ninitiatives to raise awareness and judges facing implicit public pressure to\napply harsher sentencing for offenders. In 2016, Queensland introduced laws\nwhich made strangulation a stand-alone offence, in comparison to other states\nwhich had arguably not taken the act of strangulation as seriously. The\nQueensland Sentencing Advisory Council (QSAC) recently released research data\non sentencing outcomes during the first two years of the new stand-alone\noffence being in operation.<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">In this article, we look at the sentencing outcomes, find out whether there is a typical offender profile and check in with leading experts such as John Robertson (QSAC Chair, retired Judge of the District Court of Queensland and author of the<a href=\"https:\/\/legal.thomsonreuters.com.au\/queensland-sentencing-manual-online\/productdetail\/98037\"> Thomson Reuters loose-leaf and online service <\/a><em><a href=\"https:\/\/legal.thomsonreuters.com.au\/queensland-sentencing-manual-online\/productdetail\/98037\">Queensland Sentencing Manual<\/a>)<\/em> on whether the new laws have been a success.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Is there a\u201ctypical\u201d\nstrangulation offender profile?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In May 2019, the QSAC, chaired by John Robertson,\nreleased a <a href=\"https:\/\/www.sentencingcouncil.qld.gov.au\/research\/sentencing-spotlight\"><em>Sentencing Spotlight on choking, suffocation or\nstrangulation in a domestic setting <\/em><\/a><a href=\"https:\/\/www.sentencingcouncil.qld.gov.au\/research\/sentencing-spotlight\">(Spotlight)<\/a>. The Spotlight\nanalysed strangulation cases finalised in Queensland courts from 1 July 2016 to\n30 June 2018 and revealed that offenders were typically male (98.3% &#8211; of the\n287 offenders sentenced, only five were women), aged 20 to 29 years (the\naverage age of offenders was 31.8 years; the youngest offender was 15, the\noldest 60 years old), non-Indigenous (21% identified as Aboriginal and Torres\nStrait Islander) and sentenced on a plea of guilty (99% of offenders with\nstrangulation as their most serious offence (MSO) pleaded guilty). Almost half\nof the finalised proceedings involved a breach of a domestic violence order at\n49%.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What were the\nsentencing outcomes for strangulation offences?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Over the two years analysed, 404 strangulation\ncases were sentenced, involving 287 offenders who committed a total of 482\noffences. Choking, suffocation or strangulation in a domestic setting carries a\nmaximum penalty of seven years\u2019 imprisonment. More than 76% of offenders were\njailed and received an average sentence of 1.9 years imprisonment. The longest\nsentence imposed was four years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What statute applies to\nstrangulation in a domestic setting in Queensland?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Effective 5 May 2016, s 315A of the Criminal Code\n(Qld) provides that a person commits a crime if the person unlawfully chokes,\nsuffocates or strangles another person, without the other person\u2019s consent and\nthe person is in a domestic relationship with the other person, or the choking,\nsuffocation or strangulation is associated domestic violence under the <em>Domestic and Family Violence Protection Act\n2012<\/em> (Qld) (the DFVP Act). Under s 13 of the DFVP Act, a \u201cdomestic\nrelationship\u201d includes an intimate personal relationship, a family relationship\nor an informal care relationship. \u201cAssociated domestic violence\u201d is defined under\ns 9 and includes domestic violence towards a child of an aggrieved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why was the stand-alone\noffence introduced?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The provision was inserted into the <em>Criminal Code <\/em>by the <em>Criminal Law (Domestic Violence)\nAmendment Act 2016 <\/em>(Qld). The Attorney-General and Minister for Justice Yvette D\u2019Ath\nintroduced the Bill into Parliament following a recommendation of the Special\nTaskforce on Domestic and Family Violence in Queensland (the Taskforce).\nChaired by the Honourable Quentin Bryce AD CVO, the Taskforce was established\nin September 2014 and charged with defining the domestic and family violence\nlandscape in Queensland and with making recommendations to the Premier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February 2015, the Taskforce released its\nreport<a href=\"https:\/\/www.csyw.qld.gov.au\/campaign\/end-domestic-family-violence\/about\/not-now-not-ever-report\"> <\/a><a href=\"https:\/\/www.csyw.qld.gov.au\/campaign\/end-domestic-family-violence\/about\/not-now-not-ever-report\"><em>Not Now, Not Ever: Putting an End to Domestic and Family\nViolence in Queensland<\/em><\/a>. The report identified that strangulation,\nchoking or suffocation was a key predictor of domestic homicide, and a sign of\nescalating violence and increased risk to the victim. The report recommended\nthat a separate stand-alone offence was required to recognise this specific\nbehaviour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This finding was backed by research undertaken in the US.<a href=\"https:\/\/www.smh.com.au\/lifestyle\/life-and-relationships\/this-is-the-last-warning-shot-before-a-man-kills-his-partner-20180807-p4zvxy.htm\"> <\/a><a href=\"https:\/\/www.smh.com.au\/lifestyle\/life-and-relationships\/this-is-the-last-warning-shot-before-a-man-kills-his-partner-20180807-p4zvxy.htm\">Gael Strack, CEO of the\nUS organisation Alliance for Hope, called strangulation \u201cthe last warning shot\u201d<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Has the introduction of\nthe strangulation offence been a success?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In March 2019, Damien Carrick interviewed both Heather\nDouglas, Deputy Dean (Research) at the TC Beirne School of Law at the\nUniversity of Queensland, and Betty Taylor, CEO of the Queensland-based Red\nRose Foundation who works to eliminate domestic or family violence related\ndeaths, on<a href=\"https:\/\/www.abc.net.au\/radionational\/programs\/lawreport\/2019-03-12\/10712952\"> <\/a><a href=\"https:\/\/www.abc.net.au\/radionational\/programs\/lawreport\/2019-03-12\/10712952\">Radio National\u2019s <\/a><a href=\"https:\/\/www.abc.net.au\/radionational\/programs\/lawreport\/2019-03-12\/10712952\"><em>Law Report<\/em><\/a> and asked both experts whether they thought the stand-alone\noffence was a success.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Heather Douglas believes that the laws have been a success in\nthat non-fatal strangulations are being prosecuted when they might have\notherwise not been prosecuted at all or might have been prosecuted as assaults.\nShe thinks that there needs to be research into whether incarceration protects\nvictims long-term, especially where the victim and offender resume their\nrelationship at the end of the offender\u2019s sentence. She wonders if some women\nwill shy away from reporting strangulation because they do not want their\npartners to be charged and subsequently imprisoned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Betty Taylor does not share those concerns. She maintains\nthat in her experience women in Queensland are relieved that strangulation is\ndocumented and treated seriously by the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a release published by QSAC on 22 May 2019, Chair John Robertson said that the introduction of the stand-alone strangulation offence had led to higher sentences being imposed, pointing to two recent decisions of the Court of Appeal in September and October 2018 : <em>R v MCW<\/em> [2018] QCA 241 and <em>R v MDB<\/em> [2018] QCA 283.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c\u201cViolence of this kind is a known predictor of escalating violence and\nincreased risk to the offender\u2019s domestic partner, and clearly police and\nprosecutors are taking this very seriously, pursuing this new offence through\nthe courts,\u201d Robertson added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prior to the judgments being handed down, Judges of the\nDistrict Court were guided by Court of Appeal decisions dealing with assault\ncausing injury in a domestic setting, such as <em>R v Kelley<\/em> [2018] QCA 18. The judgments delivered in <em>R v MCW<\/em> [2018] QCA 241 and <em>R v MDB<\/em> [2018] QCA 283 provide that a s\n315A offence is objectively more serious than the offence of assault\noccasioning bodily harm and that such an offence should attract a higher\npenalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Based on the legal commentary highlighted on the topic of\nstrangulation sentencing outcomes, we see how the legal landscape is changing\nin this area, arguably for the better. As to whether tougher sentencing\noutcomes for domestic violence acts such as strangulation will reduce how\nfrequently they occur, we can only hope statistics will start to improve over\ntime.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Queensland has introduced tougher legislation against a domestic violence act.
