With CoCounsel Legal for law firms, you can view the source behind any answer and see the reasoning that produced it. This guide shows you how to verify AI outputs across the matters you supervise, starting with legal AI grounded in authoritative content such as Westlaw and Practical Law.

Is AI only as good as the content it reasons with?

In Thomson Reuters’ Future of Professionals Report 2026, 94% of professionals said AI outputs must be grounded in authoritative content. They understand that trust comes not only from how the AI tool works but from knowing it is drawn from authoritative sources.

AI tools can only draw on the content available. Therefore, when choosing legal AI, make sure it is built on trusted legal research content and shows how it reached each answer. Where each citation links to its source document, you can read and confirm the authority yourself.

Where does unverified AI work expose you and your firm?

When AI assisted work goes out unchecked, you and your firm are exposed because of the duties you owe the Court, the duty you owe to further the overarching purpose in civil proceedings and duties owed to your clients.

1. Duty to the Court

Filing documents that misrepresent the law, rely on fabricated evidence or non-existent cases may breach your duty to not mislead the Court. Federal and State courts and tribunals have introduced guidance on AI, and they differ on whether AI can be used to prepare court documents and when its use must be disclosed. For example:

Forum

What it expects

Source

Federal Court of Australia

Where AI has been used to prepare a document, a responsible person confirms its accuracy.

Disclosure of AI use in specific circumstances.

Use of Generative Artificial Intelligence Practice Note (GPN-AI), 16 April 2026.1

Supreme Court of NSW

Authors of AI-assisted written submissions must verify, and state they have verified, every case, law, and other source they cite, and cannot leave that verification solely to a generative AI tool.

Generative AI must not be used to generate the content of affidavits or witness statements.

Practice Note SC Gen 23, in force since 3 February 2025.2

UCPR 35.3B, 31.4 (3A – C), 31.27 (5-8) and 51.36 (1A).3

Supreme Court of Victoria

Content produced using AI must be verified with meaningful human control.

Caution must be exercised if AI is used to assist in the preparation of evidence.

Court users must be prepared to identify the specific portion of Court documents produced using AI and explain how the output was verified.

Practice Note SC Gen 25 commenced 14 May 2026.4

Fair Work Commission

Anyone using generative AI to prepare a document for lodgement must disclose that use in the document, then review and correct it so the details are accurate and relevant.

The author of a witness statement or declaration must confirm the content reflects their own knowledge.

Guidance note: use of generative artificial intelligence in Commission cases, 24 August 2026 commences 20 Oct 2026.5

Other courts and tribunals, including the Federal Circuit and Family Court6 and Queensland courts7, have issued their own guidance8. Be sure to check the relevant rules because the disclosure and verification requirements are not uniform.

2. Duty to assist with overarching purpose

You owe a duty to assist your clients to conduct proceedings consistent with the overarching duty to facilitate the just, efficient and cost-effective resolution of the issues in dispute9. A practitioner who fails to meet that duty can be ordered to pay costs personally in the Federal Court10 and the Federal Circuit and Family Court11, and failure can count against them on costs in NSW12, Victoria13 and South Australia14.

3. Duty to clients

You owe a duty to your clients to provide legal services competently and diligently and to exercise independent professional judgement.15 If you rely on unverified AI assisted documents, you may be referred to the professional regulator and subject to personal cost orders.16

The Courts have made it clear that lawyer who makes use of AI assisted material has to apply independent judgement before relying upon it. The NSW Court of Appeal has called independent verification an “absolute necessity” for practitioners who use AI assisted technology. (May v Costaras [2025] NSWCA 178 at [17])

Despite the practice notes, inaccurate or non-existent cases in AI-generated material keep reaching the courts. Damien Charlotin, a research fellow at HEC Paris, keeps an unofficial record of decisions finding AI-produced inaccuracies in filed material, with more than 110 in Australian courts.

While most of the decisions involve self-represented litigants, there have been serious consequences for lawyers including referrals to regulators and personal cost orders.17 In Re Dayal [2024] FedCFamC2F 1166, the Court referred a legal practitioner to the relevant regulator (who later restricted the practitioner to supervised practice for two years) over inaccurate citations in an AI-assisted filing. It took the same course in JNE24 v Minister for Immigration and Citizenship [2025] FedCFamC2G 1314 and made a personal costs order against the lawyer.

In Murray v Victoria [2025] FCA 731, the Federal Court ordered the solicitors to pay costs personally, on an indemnity basis, after they filed citations prepared by a junior solicitor without checking them.

How can a partner verify AI-assisted work?

In practice, litigation lawyers are adopting processes to explain, if asked, how AI was used during preparation of documents filed in court.

Unapproved AI tools undermine this. Where practitioners rely on so-called ‘shadow AI’, your firm holds no record of what the tools generated or how anyone verified the output. That leaves the firm exposed when the court, your client, your insurer, or a regulator asks.

Here are four steps covering the essentials for any matter you sign off:

Step one. Use approved tools. Know which AI tools your firm permits on client work and what each is approved for, including what information may be entered. Favour tools built on trusted legal content over tools that rely on the open web.

Step two. Own the verification. Name who will sign off on the verification of any AI-assisted work. Make sure everyone on the matter knows the forum’s rules on disclosing AI use. If you are the responsible lawyer, that professional responsibility is yours and you can’t delegate it.

Step three. Check against primary sources. Trace each citation to its source judgment or legislation, confirm that it exists, and read it to ensure that it supports the proposition for which you cite it. Don’t rely on another AI tool to do this (although you can refer to original source material accessed within an AI tool).

Step four. Keep a record. Download the chat transcript from the AI tool along with outputs. Or a note of which tools which were used, what they were used for, and who checked what and how. If a court or regulator asks how a document was checked, the record is your answer.

Two more points to be mindful of…

Adjust the steps to the task. Court document or work being delivered to a client needs all four steps every time. A lighter check may be sufficient for an internal research memo if it is labelled unverified and re-checked before it is relied upon further. Just be clear about your expectations when you delegate work.

Bring independent thought. Checking that the sources cited in an AI-assisted document are accurate won’t tell you what the analysis missed. Ask yourself what you would expect to see before you start. A tool that discloses the steps taken to produce the output helps you to check what was considered, what lines of enquiry were not explored and spot any gaps.

What counts as verified work when a court or regulator asks?

Before AI-assisted work, including any research draft, leaves the firm, the lawyer signing it off should be able to answer three questions.

Question

A defensible answer

A weak answer

Who checked it?

The responsible lawyer or author, personally, by name. The Courts expect you to show that the material you cite supports your argument, that any evidence you refer to is before the court, and that you can substantiate factual claims.

Another AI tool, a secondary summary, or memory.

Can you show your work?

A record of the tool used, the sections of the document prepared with AI assistance, and the checks performed.

No record, or one created after the question was asked.

What does verification look like in practice?

This scenario shows how an employment law partner at an Australian firm can verify AI-assisted work on a live matter.

Employment law scenario: sending US staff to Australia

A US corporation plans to send US-based employees to Australia on temporary assignment, and its lawyer needs to know the employment obligations that follow.
