What\u2019s changed is what accuracy alone now fails to protect you from. AI has accelerated research dramatically. But it\u2019s also exposed a new class of risk: answers that sound right, look polished, and move fast, without being defensible. In today\u2019s environment, that\u2019s not a productivity gain. It\u2019s a liability.<\/p>\n\n\n\n<p>As Sarah Jacobson, Director of Knowledge Management at MinterEllison, put it in our recent webinar, <a href=\"https:\/\/www.thomsonreuters.com.au\/en-au\/events\/webinar-westlaw-advantage-ai-powered-legal-research.html?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\">Beyond answers: a new way to do legal research<\/a>:<\/p>\n\n\n\n<p>\u201cDefensible research is work that could withstand scrutiny at every level. A partner could hand it to a client, a barrister could rely on it in court, and a regulator could follow the trail.\u201d<\/p>\n\n\n\n<p>That bar is higher than it used to be, and AI is one of the reasons why.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The hidden risk: confidence you haven\u2019t earned<\/h2>\n\n\n\n<p><a href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/what-trusted-ai-really-means-for-legal-teams-today?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\" type=\"link\" id=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/what-trusted-ai-really-means-for-legal-teams-today?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\">One of the most dangerous qualities of generative AI is how authoritative it sounds<\/a>. Outputs are fluent, structured, and decisive.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>That polish can mask fundamental problems:<\/li>\n\n\n\n<li>Case citations that don\u2019t exist<\/li>\n\n\n\n<li>Principles that are mischaracterised<\/li>\n\n\n\n<li>Nuance lost through over\u2011confident summarisation<\/li>\n\n\n\n<li>In the past, there were things lawyers could safely assume.<\/li>\n<\/ul>\n\n\n\n<p>\u201cIn the past, if you got a junior to do legal research \u2026 and they gave you a case citation, you would assume that case citation is correct,\u201d Sarah notes. \u201cYou can\u2019t even assume the case citation is correct anymore. You\u2019re starting right at the very beginning \u2013 does this case actually exist?\u201d<\/p>\n\n\n\n<p>That shift matters. Because when errors slip through, they don\u2019t stay theoretical. Advice goes to clients. Submissions get filed. Business decisions get made.<\/p>\n\n\n\n<p>And accountability still sits with the lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why verification now starts much earlier<\/h2>\n\n\n\n<p>Traditionally, senior lawyers reviewed research for quality and relevance. Today, they\u2019re often verifying the fundamentals that used to be taken for granted.<\/p>\n\n\n\n<p>That changes how work gets done:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>juniors need <a href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/resources\/resource\/how-trustworthy-content-transforms-legal-deep-research?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\" type=\"link\" id=\"https:\/\/insight.thomsonreuters.com.au\/legal\/resources\/resource\/how-trustworthy-content-transforms-legal-deep-research?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\">tools that surface sources, not just summaries<\/a><\/li>\n\n\n\n<li>seniors need visibility into reasoning, not just conclusions<\/li>\n\n\n\n<li><a href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/resources\/resource\/free-ai-vs-professional-ai-what-australian-lawyers-need-to-know-about-data-security?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\" type=\"link\" id=\"https:\/\/insight.thomsonreuters.com.au\/legal\/resources\/resource\/free-ai-vs-professional-ai-what-australian-lawyers-need-to-know-about-data-security\">firms need confidence that AI use won\u2019t introduce \u2018silent risk\u2019<\/a><\/li>\n<\/ul>\n\n\n\n<p>As Sarah explains, even subject\u2011matter expertise isn\u2019t always enough if you can\u2019t see the underlying material:<\/p>\n\n\n\n<p>\u201cIf you\u2019re looking at a case summary, an expert isn\u2019t going to be able to say it\u2019s wrong without reading the case. There\u2019s a level of basic manual verification that\u2019s going to be required for some time.\u201d<\/p>\n\n\n\n<p>Speed without traceability doesn\u2019t save time. It just pushes the work downstream \u2013 often when the stakes are higher.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What firms should expect from AI\u2011assisted research<\/h2>\n\n\n\n<p>For firms navigating AI adoption, the goal isn\u2019t automation for its own sake. It\u2019s research you can stand behind.<\/p>\n\n\n\n<p>That means AI should support legal judgment by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/westlaw-advantage-australia-more-than-an-ai-upgrade?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\" type=\"link\" id=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/westlaw-advantage-australia-more-than-an-ai-upgrade?cid=7899438&amp;chl=na&amp;sfdccampaignid=701PA00000hSBpZYAW\">showing the research path, not hiding it<\/a><\/li>\n\n\n\n<li>linking directly to primary law<\/li>\n\n\n\n<li>making verification part of the workflow, not an afterthought<\/li>\n\n\n\n<li>\u201cTechnically correct\u201d research may tick a box. But defensible research considers nuance, competing arguments, and context.<\/li>\n<\/ul>\n\n\n\n<p>\u201cYou can have something that\u2019s technically 100% correct,\u201d Sarah says, \u201cbut it\u2019s not necessarily something you can confidently take to a client.\u201d<\/p>\n\n\n\n<p>That distinction is where professional judgment still matters most.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The bottom line<\/h2>\n\n\n\n<p>AI is embedded in legal work. Courts are paying attention. Clients expect transparency. And the cost of getting it wrong is rising.<\/p>\n\n\n\n<p>The firms that will thrive aren\u2019t the ones that adopted AI first.
