The recent High Court case, Glencore\nv The Commissioner of Taxation<\/em>, has attracted attention from the entire\nlegal profession, both the law firm and corporate counsel side. <\/h4>\n\n\n\n

In The Future of Legal Professional\nPrivilege <\/em>(LPP), a live poll of over 100 legal practitioners has revealed\nhow commonly claims of LPP are made in practice. Among respondents, 65% said\nthey have had to assert legal professional privilege to prevent disclosure of\ntheir client’s confidential information at some point in their careers. <\/p>\n\n\n\n

Tyrilly Csillag, Head of In-House at Practical Law Australia<\/a>, said the outcome of the Glencore<\/em> case reminds legal counsel about the limitations of LPP and the need to comprehensively understand an organisation\u2019s cybersecurity stance. <\/p>\n\n\n\n

\u201cUnderstanding definitively now that\nour client\u2019s privilege will not operate as a \u201csword\u201d, in-house lawyers need to\nrevisit their map of where the organisation\u2019s privileged information is\nphysically held and digitally stored, and by whom, and then reassess the\nsecurity measures that protect that information,\u201d she explained. <\/p>\n\n\n\n
